China considers ending unpopular one-child policy

BEIJING -- A Chinese government think tank is urging the country's leaders to start phasing out its unpopular one-child policy immediately and allow two children for every family in the country by 2015.

Some demographers saw the timeline put forward by the China Development Research Foundation, which is close to the central leadership, as a bold move. Others warned that the gradual approach, if implemented, would be insufficient to help correct the problems that China's strict birth limits have created.

Xie Meng, a press officer with the foundation, said the final version of its report would be released "in a week or two," but Chinese state media were given advance copies.

The official Xinhua News Agency said the foundation was recommending a two-child policy in some provinces from this year and a nationwide two-child policy by 2015. It also proposed all birth limits be dropped by 2020.

"China has paid a huge political and social cost for the policy, as it has resulted in social conflict, high administrative costs and led indirectly to a long-term gender imbalance at birth," Xinhua said, citing the report.

The foundation's press officer told NBC News that the report was "the result of two years of effort."?

"China's demographic changes were analyzed in connection with seven areas," she said, citing the challenges of aging, unemployment, child and women's welfare, urbanization, education, health and family planning.

But it remains unclear whether Chinese leaders are ready to take up the recommendations. China's National Population and Family Planning Commission had no immediate comment on the report Wednesday.

'Change is inevitable'
While they are known to many as the one-child policy, the actual rules are more complicated. The government limits most urban couples to one child, and allows two children for rural families if their first-born is a girl. There are numerous other exceptions as well, including looser rules for minority families and a two-child limit for parents who are themselves both singletons.

Cai Yong, an assistant professor of sociology at the University of North Carolina, Chapel Hill, said the report carries extra weight because the think tank is under the State Council, China's Cabinet. He said he found it remarkable that state-backed demographers were willing to publicly propose such a detailed schedule and plan on how to get rid of China's birth limits.

"That tells us at least that policy change is inevitable, it's coming," said Cai, who was not involved in the drafting of the report, but knows many of the experts who were. Cai is currently a visiting scholar at Fudan University in Shanghai. "It's coming, but we cannot predict when exactly it will come."

Adding to the uncertainty is a once-in-a-decade leadership transition that kicks off Nov. 8 that will see a new slate of top leaders installed by next spring.

Cai said the transition could keep population reform on the back burner or changes might be rushed through to help burnish the reputations of President Hu Jintao and Premier Wen Jiabao on their way out.

There has been growing speculation among Chinese media, experts and ordinary people about whether the government will relax the one-child policy ? introduced in 1980 as a temporary measure to curb surging population growth ? and allow more people to have two children.

Though the government credits the policy with preventing hundreds of millions of births and helping lift countless families out of poverty, it is reviled by many ordinary people. The strict limits have led to forced abortions and sterilizations, even though such measures are illegal. Couples who flout the rules face hefty fines, seizure of their property and loss of their jobs.

Many demographers argue that the policy has worsened the country's aging crisis by limiting the size of the young labor pool that must support the large baby boom generation as it retires. They also say it has contributed to the imbalanced sex ratio as some families abort baby girls, preferring to try for a male heir.

The government has recognized those problems and has tried to address them by boosting social services for the elderly. It has also banned sex-selective abortion and rewarded rural families whose only child is a girl.

Outdated or engine of growth?
Many today also see the birth limits as outdated, a relic of the era when housing, jobs and food were provided by the state.

"It has been 30 years since our planned economy was liberalized," commented Wang Yi, the owner of a shop that sells textiles online, under a news report about the foundation's proposal. "So why do we still have to plan our population?"

Ren Hao, a Chinese journalist who recently married, told NBC that he welcomed the proposed policy change but suggested that it be accompanied by new measures in education, health care and economy in order to succeed.

"Raising a child is quite a burden nowadays so, in the end, it's up to the couples to decide whether they want to have one child or more based on their conditions," he said.

Ji Jianming, a Beijing construction project manager, argued in favor of the policy. "The one-child policy was good," he said. "It allowed China to develop rapidly and improve people's lives faster."

Though open debate about the policy has flourished in state media and on the Internet, leaders have so far expressed a desire to maintain the status quo.

President Hu said last year that China would keep its strict family planning policy to keep the birth rate low and other officials have said that no changes are expected until at least 2015.

Wang Feng, director of the Brookings-Tsinghua Center for Public Policy and an expert on China's demographics, contributed research material to the foundation's report, but has yet to see the full text. He said he welcomed the gist of the document that he's seen in state media.

It says the government "should return the rights of reproduction to the people," he said. "That's very bold."

But Gu Baochang, a professor of demography at Beijing's Renmin University and a vocal advocate of reform, said the proposed timeline wasn't aggressive enough.

"They should have reformed this policy ages ago," he said. "It just keeps getting held up, delayed."

How To Help A Loved One Experiencing Domestic Violence | Fem2pt0

Domestic violence, dating violence, relationship violence ? no matter how we label it?s not something we like to talk about. Or perhaps more accurately, it?s not something we know how to talk about ? especially when it?s happening to someone we love.

But it?s really important we learn how to talk about it ? in ways that actually help people going through it (which is far more difficult than you may think).

Why is it important to talk about? Because:

In short, you probably know more people experiencing domestic violence than you think.

What Doesn?t Work

So if you see red flags, what can you do to help someone?

Your first instinct may be to tell the victim that what they?re experiencing is domestic violence and they need to get out.

And when they look at you in surprise or act defensive and say ?I don?t know what you?re talking about?, you?ll probably be confused or feel upset and insist that they leave.

And when they say they?re not being abused (even though you?ve seen the bruises, heard the insults, and watched their self-esteem crumble) or that they can?t leave, you may throw up your hands in frustration and walk away thinking, ?well if they want to stay??

STOP ? Before you go down this very well-intentioned but disempowering path, remember their abuser has probably been working very hard to isolate the victim and destroy their self-esteem and sense of self-worth through emotional, verbal, physical, sexual, financial, and identity abuse.

This can create strong entrenched feelings of shame and embarrassment and often ?victims of domestic violence try to hide what?s going on from their family, friends, colleagues, and any other supportive person or network ? unless the abuser has already driven them away.

And while we know you have good intentions, telling them what they?re experiencing and what they should do about it can further isolate the victim who may or may not be ready to confront their abuse.

It is so important to let the victim determine the next steps, to make their own decisions and take back the power and control over their own lives.

When we make decisions for others, when we try to help them do what they are not ready to do for themselves, we are taking their power and control away from them.

For victims to find the strength and courage to safely navigate away from an abuser, they?re going to need confidence in their power and control over their own story and situation.

And that?s something you can help them with ? reflect back to them the power and control they do have and the good decisions they make everyday. ?This can help them find strength faster.

So how do you have these conversations?? They?re not always easy but here?s a list of ways you can support someone you care about to become empowered and take action to escape the abuse.

Get Support from Your Local Domestic Violence Program

Realizing that someone you care about is being abused is tough and knowing how to approach them may seem even more daunting.

Remember, you?re not alone.? You can reach out to people?s whose job it is to help people in these situations and lean on their advice.

When you call your local domestic violence program, talk to them about:

  • What you can say in the first conversation, especially to better understand what YOU feel comfortable saying. You can even practice with them or role play to make sure you?re not projecting any judgement.
  • What the victim can expect if they call a domestic violence hotline. This can help remove any mystery or fear around reaching out for help.
  • What rights, options and local resources a victim can access in your area.
  • A few basic safety planning tips to help the victim get to a safe place when they can connect with an anti-domestic violence advocate. Safety planning is a tool to help victims think through ways and resources they have ?to try to mitigate a violent situation. Each safety plan is tailored to the victim?s specific situation and needs.
  • How you?re coping with knowing someone you care about is being abused. The impact of abuse isn?t isolated to the victim and can also affect those who care about them. Vicarious trauma is real. So it?s important as you?re supporting them through this situation, that you are also getting support. For survivors of abuse, this is particularly important because it can trigger past trauma, bringing back difficult memories and emotions and leading us to project ourselves into their situation.

Talk To Them For the First Time About the Abuse

The most important thing in such conversations is to communicate your concern without judgment. Let the victim tell their own story and decide their own process.

Remember, no one understands their abuser and their situation better than them. While you may have seen some signs of abuse, there?s probably many things you don?t understand about the relationship that impact how they think and feel.

Instead, focus on creating a space where they can realize their own power and control over their lives and decide what steps they want to take. Remember, this is about them, not you and what you want for them.

Some things to keep in mind during the conversation are:

  • Use words that convey concern about their safety without judgment for their relationship or abuser. Asking why they?re staying with such a terrible person will likely cause them to shut down. Instead, use language like, ?When I saw X happen, I became concerned about your safety. Have you thought about talking to someone about what you are going through?? or ?I?ve heard similar things from other people and I know there are free and confidential hotlines available at any time of the day or night.? This type of language helps them realize they are not responsible for the abusive behavior nor do they have to defend it.
  • Reflect their own power and control back to them while showing your support. One example is, ?Here are resources when you?re ready. I encourage you to make that call. But I want you to know that this is your situation and you know what is best for you. Is there anything I can do to help??
  • Meet them where they?re at and don?t try to change their mind. What they choose to do should be respected, even if it?s to remain with the abuser. While some want to get out of the situation, some may just want the abuse to end. Abusers are not all one-sided evil people, they are complex human beings and some may have been victims in the past as well. Talking to someone safe about what they?re experiencing, seeking out options for the abusers to address their use of violence, or reporting them to the police are all valid options if that?s what the victim wants. What?s important is that they decide who they reach out to and when.
  • Remind them that no one deserves to be abused and that nothing they have done justifies violence against them. Due to the abuse, they may have internalized the batterer?s words that it?s all their fault, that they?re not good enough, that they deserve to be treated this way, and/or that no one else will love them. So reflect back to them that they are good, important, and lovable and deserve better.
  • Be a non-judgemental sounding board as they try to figure out what healthy and unhealthy relationships look like, particularly around emotional and verbal abuse. In our society, unhealthy behaviors like name calling and lashing out in anger are normalized. But in healthy relationships, people acknowledge when they make a mistake or did something wrong and apologize ? abusers don?t. So help them think through how their partner handles conflict. If the batterer does not acknowledge when they do something wrong and blames their partner for their behavior, it can help the victim see the pattern of controlling behavior.
  • Share with them services they can access and how these services can help. Offer your support by accompanying them to a domestic violence organization or be with them when they call a hotline. Remember, don?t push them into doing anything, not only is it controlling and disempowering, they are less likely to follow through.

Support Them through the Long-Haul

Remember, on average it takes 7-13 attempts at leaving before a victim is able to break free from an abusive relationship. And leaving can be the most dangerous time in an abusive relationship and in fact is when most victims are murdered. Leaving takes thoughtful planning, requires established support and needs to be done safely, especially when there are children involved. ?So your first conversation may not lead to change.

But at least you?ve planted the seed that they deserve better and there are people who can and will help.

Depending on the extent of the damage the abuser has done to their self-esteem and sense of self-worth, it can take a long time for a victim to have the strength to take any action other than what they are already doing to cope with the abuse.

So it?s important that you mange your expectations about the impact of your support. You can?t save anyone but you can be there for them, unconditionally.

Otherwise, you can easily end up feeling frustrated and resentful. It can lead to moments where you want to cry out, ?why don?t you just leave??, ?just listen to me and go talk to this organization!?, or even ?I spent all this time researching services for you and you didn?t even call me back!?

It?s not uncommon for people to want to rescue others. While it?s well-intentioned, when we try to solve other?s problems for them, we disempower them.

At the same time, supporting someone in an abusive situation can be difficult and scary. As we mentioned already, get support for yourself from the local domestic violence agency. If you?re a survivor, it?s especially important to take care of yourself so you are not triggered and reliving your own trauma history.

If You Remember Nothing Else

If all this seems overwhelming, remember these words, ?No matter what you decide to do, I will support you and I will be here for you whenever you need me.?

Or if you can?t or don?t want to say that, how about, ?There are free and confidential services that can help you any time of the day or night. You are not alone.?

With these words, you?ve respected their autonomy and reflected back that you trust them to make the best decision for themselves.

And if you say this often enough, it may rise above the abuser?s voice long enough for them to take action to end the abuse.

Should next president treat Russia as friend or foe?

LONDON -- One thing is clear: whether it's President Barack Obama or President Mitt Romney, dealing with Russia will be on his "must do" list.

The "sleeping bear" has been pretty restless lately: it has vetoed U.N. Security Council resolutions on Syria and blocked U.S.-led diplomatic efforts to end the civil war there; it has refused to pressure Tehran, even though it helped build Iran's nuclear enrichment program; and relentless push-back by Russian President Vladimir Putin against basing a missile defense shield in Poland and the Czech Republic ? both former Soviet satellite states ? has left those two NATO members exposed and nervous.

But figuring out what to do about Russia first means defining who exactly Russia is. Is it, as Romney submits, America's "number one geopolitical foe"? Or, as Obama seems to believe, is Russia a post-Cold War rival with whom we can do business?

Let's step back a little here. Certainly, after the fall of the Soviet Union, relations with Russia under President Boris Yeltsin were more benign. Remember all the guffawing and back-slapping between Yeltsin and President Bill Clinton?

Unfortunately, all that good cheer soon turned into a humiliating debacle. Yeltsin was often intoxicated. He launched two disastrous wars in Chechnya, and became a laughingstock as his economy tanked and rich "oligarchs" divvied up the nation's wealth.

Then came Putin ? the former KGB agent who heavy-handedly stopped the hemorrhaging. He re-established Kremlin control over oil and gas, and as oil prices tripled he pumped billions of petro-dollars into his military and, as importantly, into the salaries and pensions of Russian voters.

'An equal'
His popularity skyrocketed; and it was time for the West to take heed. At a Munich security conference in 2007, Putin threw down the gauntlet. He accused the United States ? under President George W. Bush ??of a murderous policy of global domination and said Russia had the weapons to "neutralize" any missile defense near its borders.

It was not a declaration of war, but it was a turning point ??from an America-friendly?to a confrontational Russia. "Russia was back," Fyodor Lukyanov, managing editor of Russia in Global Affairs, told me. "That was the message ??we have the resources. You need the resources, and you need to treat Russia with respect. As an equal."

And the chill began to thaw. Dmitry Medvedev succeeded Putin as Russian president and seemed more open and Western-minded than his mentor.

He and his counterpart, Barack Obama, agreed to "reset" relations, hoping that the rebooting would clear all the static. Soon, both sides came together on transporting supplies for U.S. soldiers in Afghanistan across Russian territory; cooperation in areas like counter-terrorism and narcotics interdiction increased; Medvedev even championed some political reforms that would have guaranteed the emergence of a real opposition. That is, until Putin retook the presidency last May. Since then, he's rolled back all the reforms, and seems to have "re-reset" U.S.-Russian relations to the days of the Cold War.

Russia warns Obama's 'reset' in relations 'cannot last forever'

Putin is turning the screws, and not just by dramatic moves, like imprisoning members of the female punk group, Pussy Riot, on charges of blasphemy for having performed an anti-Putin song in a Moscow church.

Members of the band Pussy Riot, arrested in February after storming a Moscow cathedral, were sentenced to two years in jail Friday. Critics say the arrest was Putin's personal revenge, raising questions about justice in Russia. NBC's Duncan Golestani reports.

"A pale of repression is settling over the country," wrote Ariel Cohen of the Heritage Foundation in a recent New York Times editorial. "This crackdown is wrapped in legislative garb, but the iron grip of authoritarianism is unmistakable."

New laws now slap pro-democracy protesters with large fines for "illegal assembly." One protest leader ? Sergei Udaltsov, the head of the Left Front ? has been charged with "plotting riots" and could spend 10 years in jail.

Anti-Putin activists pay high price, but refuse to back down

Others may follow ??the courts have just expanded the meaning of "high treason" to include the sharing of information with any foreign non-governmental organization. In addition, NGOs which get funding from abroad must now register as "foreign agents," echoing the days of Cold War espionage.

And even as our presidential candidates debate whether Russia is a friend or enemy, there seems little doubt that Putin himself sees America as a looming geopolitical target. In the past six months alone, while supplying arms and support to Syrian President Bashar Assad's regime, Putin has shut down a U.S. government program inside Russia that dismantled its obsolete nuclear weapons; he's closed the UNICEF offices, and restricted USAID's operations there.

Russia tells US: We don't' want your aid money

As his anti-American policies multiply, it's small wonder that in a recent national poll, Russians were seriously divided on whether they loved America?or hated it (46 percent to 38 percent, respectively).

Conservatives like Cohen are frustrated. While Putin turns Russia into a "fortress," they say, the Obama administration keeps offering up carrots, like gaining Russia access to the World Trade Organization.

Vice presidential hopeful Paul Ryan praised running-mate Mitt Romney's foreign policy stances at the last presidential debate, telling TODAY's Savannah Guthrie that the GOP candidate did a "fantastic" job of spelling out his doctrine.

They claim the reset just hasn't worked.

"America should pursue its national interests in relations with Moscow, instead of pursuing a feel-good mirage," Cohen wrote.

'Putinization' spreading in Europe, US group warns

President Romney says he would stand up to Russia and talk tough about human-rights abuses. But it's less clear just how a 2nd term Obama presidency would deal with Putin's Russia.

Putin himself has said that he'd rather work with Obama than with the "misled" Romney. That's understandable ? on Obama's watch, Putin has succeeded in cracking down on civic dissent at home and building the world's largest publicly-traded oil company ? Rosneft.

Some Russia analysts are calling strategic energy reserves Putin's "new Red Army" ??the Kremlin now controls some 25 percent of Europe's, including European NATO members', energy needs.

But does all of that make Russia an enemy, like al-Qaida or Iran? Hardly. Still, it probably means that the next U.S. president is going to have to take off the gloves in dealing with it.

"Putin's understanding of international affairs comes down to a fight for power and prestige," says Lukyanov.

And Putin seems intent on using that power and prestige to counter U.S. influence around the globe, even as he turns Russia back into a police state.

Vice President Joe Biden ?reacts to President Obama's performance in the third and last debate, noting the president has demonstrated the "grasp and a gravity" of foreign policy.

The columnist John Vinocur recently suggested that, if re-elected, Obama should "stand up with protesting Russians the next time they fill Moscow's streets."

But how many protesters ? and their leaders ??will be languishing in jail by then?

When Maelle Gavet (pictured) first arrived in Russia as a student in the days following the fall of the Soviet Union, the shops were empty and the phones didn?t work properly. Two decades on, she heads Russia?s leading e-commerce site Ozon.ru ? Russia?s answer to Amazon.com ? that is well on its way to turnover of $1bn a year.

Ozon was well ahead of its time, launching only two years after Amazon at a time when even bricks and mortar retail in Russia was in its infancy.

?Ozon was very early into the game, launching even before there was really a functioning internet in Russia,? says Gavet. ?We are lucky, we have shareholders with a very long-term horizon.?

It is still very early days for Russia?s e-commerce sector but its development is following the same path as traditional retail: a few market leaders have emerged and are rapidly grabbing market share as the rising tide of higher incomes lifts everyone.

Ozon started life as an online bookstore and has grown into by far the largest e-commerce business in Russia. ?Ozon.ru is made up of four businesses,? said Gavet, sitting in the company?s relatively modest offices in the leafy Sokol district of northern Moscow. ?Ozon.ru is an online retailer, O-courier focuses on shipping, Ozon.Travel, and our most recent acquisition Sapato is the leading online shoe and accessory retailer.?

Revenues from Russia?s internet are growing at 30 per cent a year. A survey by market researcher VTsIOM in September suggests that 60 per cent of the population uses the internet compared with just 24 per cent in 2006. The volume of online business is growing even faster: last year, Russians spent an estimated Rbs554bn ($17.8bn) on goods bought from online shops, consumers sent Rbs167bn through the internet using online payments systems, and advertisers spent Rbs24bn on contextual ads and another Rbs16bn on media advertising such as banner ads, according to a survey by the Russian Association of Electronic Communications and the Higher School of Economics.

As the market leader, Ozon?s sales are outpacing the rest of the sector and have grown from $19m in 2005 to top $300m in 2011 and were up 80 per cent that year alone. Gavel says the goal is to become a billion-dollar-a-year company and it is ?not going to take another 10 years to get to that point?. The value of the online retail sector is likely to hit $100bn by 2020, up from its current $6bn, according to some estimates.

?About half the population is already online and of that some 20 per cent have bought something using the internet,? says Gavet. ?In 2011, there were about 10m to 15m buyers online, but this is still growing very fast and we expect this to rise to 20m this year. Ecommerce companies are all looking for that famous scale effect and this is still not happening.?

With its basic building blocks in place the company has already moved to the second phase of broadening its offering and building a business platform other companies can use, in addition to its own core retail business lines.

In 2011, Gavet managed to bring in $100m of fresh investment and her life was made easier by first the Mail.ru IPO in London and then the Yandex IPO, which had the effect of focusing international investors on the potential of the Russian internet.

Ozon was raising money with no particular purpose in mind but immediately spent a chunk of it buying the shoe retailer Sapato.ru, itself a local start up by Fast Lane Ventures, a Russian incubator that focus on online retail and the company?s first major exit. (Financial details of the deal have not been made public.)

?The site is already running and in just a few weeks we have seen the number of users up several hundred per cent. It is early days now, but for us it is very interesting, as this is just another channel for us to sell our services and tap into a much wider audience offered by Ozon,? says Iskander Khanbaev, head of marketing and development at Kupikupon.

With Russia?s e-commerce growth easily outpacing that of traditional retail, it is only a matter of time before Ozon becomes Russia?s third big internet IPO.

?We have no calendar for an IPO as we are still very early in our development. We want to reach a billion dollars of turnover first. There is still a lot of work to do,? says Gavet.

At seventeen years of age, 143 pounds decided that he wanted a body like Arnold Schwarzenegger?s after seeing the film Conan the Barbarian, but at the time commercial gyms in his hometown of Chemnitz, East Germany, were non existent. Instead of abandoning his interest in bodybuilding, he created his own weight set. Following the demise of communism, entrepreneurial activities in the East of Germany spawned and with that the first gym opened in Ronny?s hometown. He soon joined and began absorbing information about diet and weight training from other members and fitness magazines. At his first competition, the Hessian Championships, he placed last in his class. But he did not become discouraged, he came back a year later and won the 1995 NABBA German Nationals and placed third at the NABBA Mr. Universe. From then Rockel decided that he had the potential to become a professional bodybuilder. It was not until 2002 that Ronny Rockel achieved professional status by winning the International German Championships. After this victory he won a contract with a nutritional company and relocated with his girlfriend to Venice, California for some time while competing.

HP has just announced pricing and availability for its burgeoning Windows 8 lineup of hybrid PCs, notebooks, all-in-ones, desktops and business PCs. The company seem to be wooing every niche out there with a huge (and confusing) array of products running the newfangled OS, and though we already knew the score on many, the picture is now (almost!) complete. The 11.6-inch Envy x2 hybrid (shown above), powered with an Intel Clover-Trail flavored Atom processor will come on the scene on November 14th starting from $850, for instance, and we also have the scoop on the HP Envy TouchSmart Ultrabook 4, HP Phoenix h9 desktop PC and HP Pavilion dm1 (with new 4G connectivity) after the break. James Bond blends old and new charms as 007 turns 50

NEW YORK (Reuters) - Makers of the new James Bond movie "Skyfall" have striven to combine the old-school values that made 007 such a success over the last 50 years with enough modern mores to keep the silver screen's favorite super spy relevant in a post-Cold War world.

The 23rd official Bond film, which has its royal world premiere in London on Tuesday, brings together Daniel Craig on his third outing on Her Majesty's secret service with British director Sam Mendes making his franchise debut.

The plot also puts veteran actress Judi Dench, 77, at the heart of the action as Bond's superior M, and introduces Spanish Oscar-winner Javier Bardem as an uncharacteristically flamboyant villain complete with dyed blond hair.

Marking 50 years after the first Bond film "Dr. No" premiered on London in 1962, Skyfall pays homage to Bond's gadgets, his taste in fast cars and beautiful women and introduces enough humor to lighten the tone.

But it also seeks to show why the modern Bond is still relevant in a world where technology is as important to international spy networks as human beings.

"He was a product of his time and we live in a different time and I hope this movie reflects the time we live in," Mendes told reporters at a recent publicity briefing.

He said the film served to answer questions about the relevance of Britain's foreign intelligence agency (MI6) and the Bond character now that the Cold War is over.

"We are talking about old values, which is what the movie argues for -- honor, trust, friendship, courage -- and in a way it is deeply old fashioned in its values," Mendes said.

The tension between current intelligence gathering methods which rely more on satellites and computer hacking than Bond's traditional sleuthing approach adds a degree of tension to the 23rd outing for the fictional spy character created by author Ian Fleming, Craig told Reuters in an interview.

"Bond is very much within the old camp, which is that you have got to go and look people in the eye and ask them questions directly. And there we have the clash of the worlds," Craig said.

In Skyfall, which features a new theme song performed by Adele, Bond travels between Istanbul, Shanghai and London as his loyalty to M is tested when her past comes back to haunt her, while MI6 comes under attack from an unknown threat.

Craig as the modern Bond gives the audience snippets of vulnerability that counter the all-knowing cockiness of past Bonds. In Skyfall, he quickly learns he is dispensable, growing older and forced to face the ghosts of his childhood.

"He is a complicated character and that is worth looking at," the 44-year-old Craig said, adding that even after his first Bond outing, "Casino Royale", and then "Quantum of Solace", released four years ago, he was still discovering the layers of Bond.

"I try to sort of hint at it, as opposed to exploring it."

Bond's famed smooth charm, and his willingness to use women for personal gratification have earned him his fair share of critics over the years. But fans will still recognize the Bond of old, Craig said.

"Women are there to satisfy him, I think he still believes that. But if we put strong women in front of him, then there is going to be some friction.

"But I kind of have to cling onto his chauvinism a bit, because I think it makes things more interesting."

Audiences can't "be too PC about it," said Craig, "It's a gag. Everybody has got the gag for this long. We understand the gag. It's about making sparks, you want sparks. Death is sexy. Danger is sexy. It's all about getting those elements into it."

EARLY BOND NODS

The pressure of marking the 50th anniversary of one of cinema's most recognisable characters and valuable properties was pushed to the background during filming, according to Craig.

This year has already seen exhibitions, auctions, a documentary and plenty of merchandising to mark the cultural phenomenon that is Bond.

The film suffered a delay due to financial troubles at studio MGM, allowing for several script rewrites.

"It was in the back of our minds," Craig said, adding that the joke on set was that Skyfall might be a huge flop spelling the end of the franchise after five decades.

Instead, the movie tries to emulate the slick costume design and style of those 1960s Bond films, including bringing back the Aston Martin DB5.

"I remember going to see Bond movies and being transported somewhere and that was what we aimed for on this," Craig said. "It picks up things from those early movies."

Critics in Britain have praised "American Beauty" director Mendes for stronger characters and letting dramatic moments in the film breathe.

The film is released in Britain on Friday and on November 4 in the United States. The 22 Bond films have made around $5 billion at the box office.

Like the franchise, Craig said he will be "pushing 50" when he has completed the next two Bond films under his contract and promised to "completely" call it quits.

In the meantime, "If you find yourself being bored of playing James Bond, then you are really ready to give up," he said.

Advertising invoice 'scammers' arrested in SFO Investigation... | Stuff ...

Six people have been arrested over an alleged advertising invoice scam.

Operation Edit - led by the Serious Fraud Office - targeted a group that allegedly sold advertising in magazines that were either never printed or had print numbers and circulation exaggerated.

The SFO said the magazines were titled to suggest worthwhile causes including road safety, parenting or drug addiction. It is alleged that the scam generated up to $1.6 million since 2008.

Five accused have been charged with multiple fraud offences and with participating in an organised criminal group. A sixth accused has been charged with participating in an organised criminal group. The arrests were made in Auckland, Picton and Port Waikato with over 60 staff from the various agencies involved in the operation.

"Invoicing scams cost New Zealand businesses hundreds of thousands of dollars a year and small businesses and charities are often the target," Simon McArley, acting SFO chief executive said.

"While the dollar amount of alleged offending is not huge, taking action in relation to high volume/low value fraud is important. Overall there can be a significant impact on the economy."

"By tackling this problem we build the business community's confidence in the market and enhance legitimate economic activity," he said.

The SFO led the nationwide operation - which involved search warrants or activity at more than 25 locations nationwide - with help from the police, Organised and Financial Crime Agency of New Zealand, Commerce Commission, New Zealand Customs, and Inland Revenue.

"The agencies were able to each contribute specialist skills and achieve a result that none working alone would have been able to. High volume/low value fraud is particularly difficult to address effectively, and this is a good example of agencies bringing together their skills from within their existing resources to address this," McArley said.

Egypt ruling allows time for constitution

CAIRO (Reuters) - A legal case against the assembly writing Egypt's new constitution was referred to the country's top court on Tuesday, a move likely to give the Islamist-dominated body enough time to complete its work before the judges can rule.

The step appeared to remove legal doubts overshadowing a process that will shape the post-Hosni Mubarak era. But the assembly still faces a struggle to build consensus around a text that is exposing fault lines in Egypt's new political landscape.

"The case is finished. The challenge will now be a political one, not a legal one. If you don't have a consensus you will have a big crisis," said Hassan Nafaa, a professor of political science at the University of Cairo.

The new constitution is a major component of a transition from military-backed autocracy to a democratic system of government that Egyptians hoped would follow the popular uprising that swept Mubarak from power last year.

Yet its drafting has been marred by political bickering. Non-Islamists say the process has marginalized other voices in society. Much of the debate has been shaped by a tussle over the role Islam should play in government.

There are also complaints the text falls short of hopes for revolutionary change sought by parties that were due to launch a new initiative to press their demands - a sign of a push to shape the debate.

The judge hearing 43 complaints against the way the assembly was formed sent the case to the Supreme Constitutional Court. Plaintiffs, many of them motivated by alarm at the Islamists' sway, argued the 100-person assembly had been formed illegally.

Legal experts said it could take months - up to six by some estimates - for the constitutional court to examine the case. Barring an exceptional burst of activity by the judges, that means the assembly will have time to finish the constitution by December's deadline. The text will then put to a referendum.

"The decision gives the assembly the chance to finish what it started by completing the draft and putting it to a referendum," said Abdel Moneim Abdel Maqsoud, a Muslim Brotherhood lawyer, at the end of a chaotic court session punctuated by chants for and against the assembly.

"Once the constitution is approved in the referendum ... the Supreme Constitutional Court has no authority over it."

"CRUNCH TIME"

The constitution has been the focus of political and legal struggle since the start of the year. The Muslim Brotherhood and the Nour Party - both Islamist groups - secured an influential say over the process by winning a majority in the first parliamentary election held after Mubarak's removal from power.

But the assembly formed shortly afterwards was dissolved by a court ruling in March after plaintiffs fought a successful legal battle over its make-up. Subsequently, parliament itself was dissolved. New legislative elections are scheduled to take place after the constitution is passed.

According to an October 14 draft, the new constitution will guard against the one-man rule of the Mubarak era and institutionalize a degree of civilian oversight - not enough say the critics - over the military establishment that had been at the heart of power since a 1952 coup.

The draft has been criticized for failing to provide enough protection for rights such as the freedom to form trade unions, which it links to unspecified future legislation. Experts say the vagueness of some of the articles smacks more of the autocratic past than a democratic future.

Highlighting the concerns of the non-Islamists, the liberal Dustour Party headed by Mohamed ElBaradei and the Popular Current, a leftist party founded by defeated presidential challenger Hamdeen Sabahi, are launching a campaign for a "revolutionary constitution", a Current spokeswoman said.

Zaid Al-Ali, a constitutional lawyer who has been monitoring the process, said it was now or never for Egyptians to reach a consensus on the new constitution. "It's crunch time," he said.

"They have two months to rebuild trust between each other, iron out the inconsistencies and gaps in the draft text, and convince the country that the coming constitution is the best available solution for the country," he told Reuters.

Ahmed Said, head of the liberal Free Egyptians' Party, said President Mohamed Mursi must now intervene to appoint a more balanced assembly, indicating that street protests were the only path left for people seeking to change the assembly.

"The issue went out of the arena of the courts and has become one of the people," he told Reuters.

NBA to change All-Star ballot, eliminating center

The NBA is finally doing something about the Duncan Dilemma.

The league will announce Wednesday a change to its All-Star ballot that will, for the first time, allow fans to vote for three undefined "frontcourt" players instead of having to vote for two forwards and a center. With more and more teams playing smaller than in the past, the definition of "center" was becoming increasingly difficult -- not to mention finding enough quality big men for whom to vote.

For years, for example, the Spurs have listed Tim Duncan as a power forward, even though everyone on earth knew he was their starting center. And so when it came to All-Star balloting, Duncan would take up a forward spot in a very crowded field of Western Conference stars instead of his logical spot in the middle. This was good for Duncan, who surely would have made his 13 All-Star teams anyway, but it often cost another forward a shot.

The league decided to make the change after the NBA's Competition Committee agreed to the move at its meeting last month, VP of Basketball Operations Stu Jackson said Tuesday evening.

"It makes sense," Jackson said. "It made sense to our Competition Committee. Having a center is the only specific position that was singled out on the ballot. It just seemed a little outdated and didn't represent the way our game has evolved. By the same token, it also affords the same opportunity, if you have two good centers in a given year, pick 'em both. They both can be selected. Which is impossible right now."

That would be good news for players like Boston's Kevin Garnett and Miami's Chris Bosh, nominal forwards who are now playing center for their respective teams. Under the old rules, Garnett and Bosh would have been in the center category with the likes of Philadelphia's Andrew Bynum, Atlanta's Al Horford and Indiana's Roy Hibbert. Now, any of them can be selected as a "frontcourt" player.

"It was something that we originally thought made some sense, but we didn't want to make a decision in a vacuum, of course," Jackson said. "We ran it by the Competition Committee and they thought the idea made some sense ... it gives the fans some flexibility while keeping competitive balance."

The league will debut the 2013 All-Star ballot on Nov. 13. Players are selected for the ballot by a committee of national media who cover the NBA on a regular basis. The 2013 All-Star Game will be Feb. 17 at the Toyota Center in Houston.

Introduction
Governor Brown formulated his 2012-13 fiscal year state budget based on the assumption that Proposition 30 would be approved by the voters in this November?s election. This proposition would raise income tax for seven years on taxpayers with incomes of $250,000 or more, and raise the sales tax for four years by a quarter percent. To provide historical perspective, this blog examines monthly state revenue and expenditures beginning in January 1999.

Monthly State Revenues
Monthly data on total state revenue for the General Fund, as well as its sub-components, such as sales tax and income tax, is published in the State Controller?s Monthly Financial Reports. This data is in current total dollars. It was corrected for inflation and converted to August 2012 dollars using the consumer price index for the Los Angeles Consolidated Metropolitan Statistical Area, published by the California Department of Finance. This constant dollar data was then put on a per capita basis using annual population figures taken from the state Statistical Abstract, and interpolated to obtain monthly values. The resulting total revenue per capita, corrected for inflation, is highly seasonal, with peaks in April, June, and September, for example. To control for seasonality, year over year changes were used for each month (January 2000 minus January 1999, etc.), as illustrated in Figure 1.

Note that the year over year changes tend to be clustered around zero, with a median of $-2.80 per capita. There are several positive exceptions and several negative exceptions. Of the five negative changes, three are associated with the 2001 recession, and one is associated with the Great Recession (recessions are indicated by the shaded areas). Recessions are random events or shocks, and are not predictable. For example, none of the business economists in the Survey of Professional Forecasters?foresaw the Great Recession until it was well underway. That leaves only one exceptional negative year-over-year change without explanation.

Of the five positive year-over-year changes, two are in the big income tax month of April (2000 and 2005). The other three are in three, seemingly, unrelated months: January 2001, September 2003, and March 2010. Thus, there seems to be little predictability for exceptionally good months. The Financial Research Unit?at the Department of Finance, which is responsible for the budget forecasts, has a different view. They focus on forecasting personal income tax, or PIT.

These ten exceptional year-over-year changes, both positive and negative, can be confirmed using a visual tool known as the box diagram, developed by the renowned statistician John Tukey. The vertical line in the box is the median or middle value. The box contains 50% of the 152 observations. The upper whisker represents the largest 25% of the observations with the exception of the outliers. If any year-to-year change is greater than 1.5 times the length of the box, it is an outlier. There are five positive and five negative outliers, as depicted by the red dots (two of the positive outliers are close in value to other outliers, so only three are visually distinct).

If these ten outliers are removed from the year-over-year changes in total revenue per capita in August 2012 dollars, then the remaining 142 observations are normally distributed. From this analysis we conclude that large increases or decreases in year-over-over-year total revenue, i.e. outliers, are not predictable because of their nature. The remaining observations of year-over-year changes are positively auto-correlated, which means that while times are good they will tend to stay that way. The same goes for when times are not so good.

To gain insight into factors affecting real per capita revenue, it was regressed against seasonal indices to control for seasonality, trend, the Case-Shiller Ten City Composite House Price Index (not seasonally adjusted), and an index of the 2001 recession. All of these variables were significant.

Total Expenditures
Monthly data for disbursements from the General Fund is also published by the Controller. It is available for expenditures on state operations and on local assistance. The plot of the year-over-year changes for the sum of these two is shown in Figure 3. There are six positive outliers and seven negative outliers. There is no apparent pattern to the positive outliers, although two thirds came during or after the Great Recession. The impact of the Great Recession is even more noticeable on the negative outliers, where six out of seven came during or after this most recent downturn. The median of year-over-year changes in expenditures is $1.3 billion per capita.

Real expenditures per capita were regressed against seasonal indices, trend, indices controlling for the 2001 recession and the Great Recession, and the Case-Shiller Ten City Composite House Price Index. The Great Recession was not significant.

Budget Balance and State Government Borrowing
The difference between state government revenue per capita and state expenditures per capita, i.e. the approximate budget balance, tends to be negative. As a consequence, the state has resorted to borrowing. The amount borrowable and the amount of loans, both in billions of nominal dollars, can be obtained from the California Controller?s Monthly Financial Reports. These amounts are depicted in Figure 4 for the terms of three Governors: Gray Davis, January 1999-November 2003; Arnold Schwarzenegger, December 2003-December 2010; and Jerry Brown, January 2011 to date.

When Gray Davis succeeded Pete Wilson as Governor, California was borrowing money, but less than $5 billion in any month. The first years of Governor Davis? governorship were also the years of the dot-com boom, and by June 2000, Davis reduced the amount of loans to zero, and kept it at that level through July 2001.? By then the legislature had spent the capital gains tax windfall on permanent increases to the budget. ?Although Governor Davis had not stopped this from happening, he had warned against it. Loan amounts increased rapidly, and, by October 2002, reached $18.3 billion. The potential amount that could be borrowed had also been increased dramatically, as shown in Figure 4. In May of 2003, the loan balance of $23.5 billion was comprised of $11 billion of internal borrowing, and $12.5 billion of external borrowing. In November 2003, Governor Davis was recalled.

After Schwarzenegger became governor, he managed to reduce borrowing to zero after seven months, and kept it below $10 billion until March of 2007. He was also successful in reducing the potential amount borrowable. However, by ten months into his new term, in October 2007, state borrowing had reached $13.5 billion, and remained above $10 billion for six months. During the remainder of Schwarzenegger?s tenure, state loans trended upwards hitting a peak of $24.8 billion in December 2009. The potential amount borrowable also grew dramatically in Schwarzenegger?s second term, as illustrated in Figure 4. Since some of the borrowing was internal, i.e. from other funds, it highlights the importance of other funds as part of the state budget process. Note that borrowing tends to peak in the middle of the fiscal year, circa December, and then declines toward June (the end of the fiscal year), as other funds get paid back.

The Wall of Debt
Governor Brown refers to accumulated state borrowing as the ?Wall of Debt,? and included a listing of monies owed in his Introduction to the 2012-2013 Budget Summary, reproduced below as Figure INT-04. The state has borrowed from various constituencies, including schools and local governments. Of particular interest is borrowing from special funds, which is listed as $3.4 billion, up from $749 million in June 2008. The State Controller published a report, Cash Management and General Fund Borrowing, which explains in general terms how the state borrows both externally and internally, and how it can borrow interest free on up to ten percent of a threshold from special funds.

The Role of Other Funds in State Finance
The General Fund has been the main fund collecting revenues and spending on state operations and local assistance. However, there are about 560 special funds, most of which are financed from user fees, to be spent solely on specific purposes. In recent years, the state has resorted to borrowing billions from these special funds, which has increased their prominence in state finance. One of the largest special funds is the State Highway Account, with a balance of $1.77 billion. (A fund?s balance is the net of assets minus liabilities.) Another special fund from which the state has borrowed is the Beverage Container Recycling Fund, with a balance of $226 million. There are scores of smaller funds with zero balances, such as the Charity Bingo Fund.

In August 2012, the Legislative Analyst?s Office (LAO) published special report for the legislature, entitled Issues Concerning the Accounting of California?s Special Funds. Among the issues this report mentions is the use of $16 billion of special fund and other fund cash to pay General Fund bills during this fiscal year. The report also recommends the development of a strategy for the state to repay these special fund loans in the years ahead. One issue the LAO report did not focus on is the Mental Health Services Fund, with a balance of $1.46 billion. This fund diverts income tax dollars away from the General Fund, which exacerbates the state fiscal crisis.

The Mental Health Services Act
In the November 2004 election, California voters passed Proposition 63, The Mental Health Services Act. It imposed an additional one percent income tax on incomes in excess of one million dollars. This may sound attractive, but it was simply a diversion of state income tax away from the General Fund. As policy, it ignored fundamental economic truths. First. There is no free lunch. Second, There is an opportunity cost: the personal income tax revenue that finances the Mental Health Services Fund is no longer available to the General Fund. Third, this constrains the flexibility of the governor and the legislature to fund state services since it pigeonholes money in this specific fund, and these constraints lead to a sub-optimal allocation of the budget. It short, it was, and is, bad policy. It also diverts large amounts of money, as shown in Table 1.

The fact that the state is outspending its revenue, and is looking for money and for new sources to borrow from, places local governments at increasing risk that their resources may attract state attention.

Summary
This blog has focused on the developing state fiscal crisis, which has grown during the terms of the last three governors. We found that there were a few months of exceptionally high or low revenue outliers, which were unpredictable, large swings. The same was true of a few exceptional high and low months of expenditures. This underscores the need for a ?rainy day fund,? known as the Special Fund for Economic Uncertainties (SFEU). Unfortunately, the state is so strapped it cannot finance the SFEU, and has to, increasingly, borrow billions from the special funds. This has created new issues, since these special funds usually are financed from user fees to meet specific and restricted purposes. The state can borrow up to ten percent of threshold amounts from these special funds, interest free. The state debt to these special funds is already several billions of dollars, with no clear plan, as well as no current means, for repayment.

SAN DIEGO (AP) ? It could be the muffled sound of singing in the shower or that sing-songy indecipherable voice from the Muppets' Swedish Chef.

Surprisingly, scientists said the audio they captured was a whale imitating people. In fact, the whale song sounded so eerily human that divers initially thought it was a human voice.

Handlers at the National Marine Mammal Foundation in San Diego heard mumbling in 1984 coming from a tank containing whales and dolphins that sounded like two people chatting far away.

It wasn't until one day, after a diver surfaced from the tank and asked, "Who told me to get out?" did researchers realize the garble came from a captive male Beluga whale. For several years, they recorded its spontaneous sounds while it was underwater and when it surfaced.

An acoustic analysis revealed the human-like sounds were several octaves lower than typical whale calls. The research was published online Monday in Current Biology.

Scientists think the whale's close proximity to people allowed it to listen to and mimic human conversation. It did so by changing the pressure in its nasal cavities. After four years of copying people, it went back to sounding like a whale, emitting high-pitched noises. It died five years ago.

Dolphins and parrots have been taught to mimic the patterns of human speech, but it's rare for an animal to do it spontaneously.

The study is not the first time a whale has sounded human. Scientists who have studied sounds of white whales in the wild sometimes heard what sounded like shouting children. Caretakers at the Vancouver Aquarium in Canada previously said they heard one of the white whales say its name.

Paper Examines Historical Origins of America's Mortgage Laws ...

WASHINGTON, DC ? October 23, 2012 ? (RealEstateRama) ? Today the Mortgage Bankers Association (MBA) released a paper entitled, ?The Historical Origins of America?s Mortgage Laws,? conducted by Andra Ghent, Assistant Professor of Real Estate at Arizona State University and sponsored by MBA?s Research Institute for Housing America.

This paper examines the different legal frameworks for mortgage markets in different states, focusing on how and when they came into existence, including the British influence on laws in some of the older states, with a particular emphasis on foreclosures, including judicial vs. non-judicial regimes, redemption rights and deficiency judgments. Ghent concludes that mortgage laws in America are a patchwork driven by path dependence, rather than a coordinated effort or a reaction to some economic event or condition.

?This research shows that, historically speaking, mortgage laws in this country are not the result of intentional design, nor were they necessarily driven by a consistent set of economic events or circumstances,? said Mike Fratantoni, RIHA?s Executive Director. ?As a result, there may well be significant gains from ongoing efforts to harmonize these laws across the states.?

?With the exception of anti-deficiency statutes, mortgage laws seem to be the outcome of path-dependent quirks in the wording of various proposed statutes and decisions of individual judges, said Andra Ghent, Assistant Professor, W.P. Carey School of Business at Arizona State University. ?Mortgage laws have been extremely slow to change, and while this slow adjustment is perhaps necessary to maintain the integrity of the rule of law in a common law legal system, the result is a diverse set of laws that seem poorly suited to a mortgage market that is increasingly integrated across state borders.?
