Ban on gay change therapy faces first legal test

(AP) ? A California law prohibiting mental health providers from counseling gay minors on how to become straight faces its first legal test Friday, when lawyers for counselors endorsing "reparative therapy" and parents who claim their sons have benefited from it, plan to ask a judge to block the first-of-its-kind measure.

U.S. District Judge Kimberly Mueller will hear arguments on whether she should grant an injunction that would prevent the law, which was passed by the California Legislature and signed by Gov. Jerry Brown as SB1172 in October, from taking effect on Jan. 1.

The temporary delay would allow underage clients to continue receiving the therapy while its supporters seek to overturn the law on grounds that it violates their First Amendment rights to freedom of speech and religion.

If it's not blocked, the therapists and families "will be immediately and irreparably harmed by being forced to discontinue ongoing therapy in violation of their constitutional rights, by being denied the ability to direct the upbringing of their children, and by being compelled to violate their ethical obligations in order to obey the law," lawyers from Liberty Counsel, a Christian legal group, wrote in their petition.

The law Brown signed states that psychologists, social workers, family counselors and psychiatrists who use "sexual orientation change efforts" on clients under 18 would be engaging in unprofessional conduct and subject to discipline by their respective state licensing boards.

Lawyers for the state argue the ban is appropriate because it seeks to protect young people from a practice that has been rejected by mainstream mental health associations that regard homosexuality as a healthy part of the human experience and say that efforts to change an individual's sexual orientation can be harmful, particularly to children.

The outlawed therapy "can and has caused great psychological pain in young people who are already struggling with their sexuality and the stigma of being gay," Attorney General Kamala Harris wrote in asking the judge to deny the requested delay. "An injunction would expose some of society's most vulnerable members to treatment that the state and every major mental health organization in the country have condemned as an outmoded, ineffective, and potentially dangerous relic from an era when homosexuality was pathologized and criminalized."

Mueller is not expected to make a ruling at the hearing, but to issue a written decision at a later date.

The proceedings will be unusual, in part, because the judge granted Liberty Counsel's request to refer to the four parents and two teenage boys participating in the case by pseudonyms in both open court and legal documents.

Along with the petition to keep the law from taking effect, Mueller is scheduled to hear arguments on whether lawyers from the gay rights group Equality California should be allowed to join the attorney general in defending the law.

(AP) ? Britain's unruly newspapers should be regulated by an independent body dominated by non-journalists with the power to levy steep fines for ethical lapses, a judge recommended Thursday after a yearlong inquiry.

But Prime Minister David Cameron immediately expressed deep misgivings about a key recommendation in the 2,000-page report ? that the new regulator be enshrined in law. Cameron said he was concerned about government interference in free speech.

"I'm proud of the fact that we've managed to survive hundreds of years without state regulation," he said.

The impasse left questions about the eventual impact of Lord Justice Brian Leveson's sweeping probe of media ethics in Britain. The inquiry was triggered by a tabloid phone hacking scandal that expanded to engulf senior figures in politics, the police and Rupert Murdoch's media empire.

The report pleased victims of tabloid intrusion but left editors worrying about creeping state control of the country's fiercely independent press.

Leveson's key recommendation was to create a new regulator for newspapers and their websites, which he said should be established in law to prevent more people from being hurt by the "outrageous" press behavior that had "wreaked havoc with the lives of innocent people."

"The ball moves back into the politicians' court: They must now decide who guards the guardians," he said.

Cameron, under intense pressure over an issue that has divided his own Conservative Party, welcomed Leveson's proposal for a new regulator, saying "the status quo is not an option."

But the prime minister said asking legislators to enshrine it in law meant "crossing the Rubicon of writing elements of press regulation into the law of the land."

"I believe that we should be wary of any legislation that has the potential to infringe free speech and a free press," Cameron told lawmakers in the House of Commons. "We should think very, very carefully before crossing this line."

Cameron instead called on the much-criticized British press to show it could control itself by implementing the judge's proposals quickly without political involvement.

Leveson insisted that politicians and the government should play no role in regulating the press, which should be done by a new body with much stronger powers than the current Press Complaints Commission.

He said the new body should be composed of members of the public including former journalists and academics ? but no more than one serving editor and no politicians. It should have the power to rule on complaints, demand prominent corrections in newspapers and to levy fines of up to 1 million pounds ($1.6 million), though it would have no power to prevent material from being published.

Membership would be voluntary, but newspapers would join in part to stave off expensive lawsuits ? the regulator would handle complaints that now end up in court.

The proposal is similar to the system operating in Ireland, where a press council and ombudsman were set up in 2008 to make the print media more accountable.

Critics of the tabloid press generally backed Leveson's findings.

"I welcome Lord Leveson's report and hope it will mark the start of a new era for our press in which it treats those in the news responsibly, with care and consideration," said Kate McCann, who was the subject of intense press interest after her 3-year-old daughter Madeleine disappeared during a 2007 holiday in Portugal.

Brian Cathcart of the group Hacked Off, which campaigns for victims of press intrusion, said Leveson had produced "a workable, proportionate and reasonable solution to the problems of press abuse."

Cathcart called Cameron's inability to accept its recommendations "unfortunate and regrettable."

Cameron set up the Leveson inquiry after revelations of illegal eavesdropping by Rupert Murdoch's now-defunct News of the World tabloid sparked a criminal investigation and a wave of public revulsion.

The furor erupted in 2011 when it was revealed that the News of the World had eavesdropped on the mobile phone voicemails of slain schoolgirl Milly Dowler while police were searching for the 13-year-old.

Murdoch shut down the 168-year-old newspaper in July 2011. His U.K. newspaper company, News International, has paid millions in damages to dozens of hacking victims, and faces dozens more lawsuits from celebrities, politicians, athletes and crime victims whose voicemails were hacked in the paper's quest for scoops.

News International chief executive Tom Mockridge said the company was "keen to play our full part, with others in our industry, in creating a new body that commands the confidence of the public."

"We believe that this can be achieved without statutory regulation ? and welcome the prime minister's rejection of that proposal," he added.

Leveson's 4-million-pound ($6.4- million) inquiry heard evidence from more than 300 witnesses over months of dramatic, sometimes comic and often poignant testimony. Witnesses ranged from celebrities such as Harry Potter author J.K. Rowling and actor Hugh Grant ? who both complained of intrusive treatment ? to the parents of Dowler, who described how learning that their daughter's voicemail had been accessed had given them false hope that she was alive.

Leveson said the ongoing criminal investigation constrained him from accusing other newspapers of illegal behavior, but concluded there was a subculture of unethical behavior.

While many editors have denied knowing about phone hacking, Leveson said it "was far more than a covert, secret activity, known to nobody save one or two practitioners of the 'dark arts.'"

He said newspapers had been guilty of "recklessness in prioritizing sensational stories almost irrespective of the harm the stories may cause."

The hacking scandal has rocked Britain's press, political and police establishments, who were seen to enjoy an often-cozy relationship in which drinks, dinners and sometimes money were traded for influence and information.

Several senior police officers resigned over the failure aggressively to pursue a 2007 investigation into phone hacking at the News of the World. But Leveson said "the inquiry has not unearthed extensive evidence of police corruption."

Leveson said over the past three decades, political parties "have had or developed too close a relationship with the press in a way which has not been in the public interest."

Those relationships reached right up to the prime minister's door. Former Murdoch editors and journalists charged with phone hacking, police bribery or other wrongdoing include Cameron's former spokesman, Andy Coulson, and ex-News of the World editor Rebekah Brooks, a friend of the prime minister.

Still, Leveson acquitted senior politicians of wrongdoing.

Cameron was holding talks Thursday with leaders of the other main parties in an attempt to thrash out some agreement on press regulation.

He faced a battle. His own deputy prime minister, Nick Clegg, the leader of his coalition partner the Liberal Democrats, differed from Cameron in backing the call for a new regulator established in law.

"We owe it to the victims of these scandals, who have already waited too long for us to do the right thing," Clegg said.

Nate Diaz worried about judges? decision in fight with Benson Henderson

Nate Diaz is fighting Benson Henderson at UFC on Fox 6, and he has taken the idea "don't leave it in the hands of the judges" to a whole new level. He does not think he can win if it is put in the judges' hands.

"I don't think I've got a chance of winning any type of decision. So I gotta go out there and do what I can do to try and finish my opponent, try to be the better fighter and win the fight," said Diaz said to Inside MMA. "Either way, if it goes to a decision, I'm going to try to be the one outscoring, outpointing and outdoing him."

Winning by a finish is a pretty tough feat for Diaz to accomplish. Henderson has never been knocked out. He lost once by submission and once by a decision. The submission loss was in 2007. Since then, he's been in some tricky spots but hasn't tapped. In both fights against Donald Cerrone and in fighting Jim Miller, Henderson was memorably stuck in positions which seemed close to a submission. But instead of tapping, Henderson would give the thumbs up and went on to win all three fights.

Decisions in bouts with Henderson are also a likely occurrence. His last six fights were decisions, with five ending with Henderson getting his hand raised. Diaz isn't as successful in decisions, so you could see why he might be nervous. Of his seven losses, six are by decision. Only two of his 13 wins came via the judges' card.

Should Diaz be concerned? Speak up in the comments, on Facebook or on Twitter.

Who Is Scroogling Who? Bing?s Shopping Results Aren?t All That Clean, Either

Notification Center-3Microsoft started a rather controversial anti-Google campaign this morning that alleged Google is essentially misleading its users because all of the company's shopping results are now paid. The "Don't Get Scroogled" page is getting quite a bit of attention today, but at the same time, there is also some unease about how Bing organizes its own shopping results.

Torrent. In the context of consuming mainstream music and movies, the word reverberates with illegitimacy. The Bittorrent protocol, however, is neutral -- a disinterested technology specification. The same is true for all peer-to-peer platforms, and that essential neutrality has been a pillar argument in lawsuit defenses of P2P companies over the last decade.

US plunge off 'fiscal cliff' is likely, say debt gurus Simpson and Bowles

    The Monitor Breakfast

Former chairs of Obama's debt commission, Alan Simpson (R) and Erskine Bowles (D), said at the Monitor breakfast Wednesday they see just a one-third likelihood that the White House and congressional Republicans will reach a deal by year's end to avert the fiscal cliff.

    By Gail Russell Chaddock,?Staff writer / November 28, 2012

Senators Alan Simpson (r.) and Erskine Bowles (l.) speaking to reporters at a Monitor-hosted breakfast on Wednesday, Nov. 28.

Fresh from a meeting with President Obama and en route to talk with House Speaker John Boehner, the former co-chairmen of the bipartisan Simpson-Bowles debt commission say it's more likely than not that the United State will fall off the "fiscal cliff" at year's end.

There's only about a one-third possibility that Congress and the White House will reach a deal to avert some $600 billion in automatic tax hikes and mandatory spending cuts over 10 years ? an outcome that would be "devastating to the economy," says Erskine Bowles, the Democratic half of the Simpson-Bowles partnership, speaking to reporters at the Monitor breakfast in Washington on Nov. 28.

There's another one-third possibility that "we'll go over the cliff and people will come to their senses in the first week or so," he adds. A third prospect, that a deal takes even longer, "will lead to chaos," he predicts.

Mr. Bowles and former Sen. Alan Simpson (R) of Wyoming have stayed engaged with members of Congress, the White House, business and other interest groups, and the public since releasing a report in December 2010 recommending a $4 trillion "balanced" solution to America's debt crisis. That plan included a package of tax hikes, spending cuts, and reforms to save money on big entitlement programs such as Medicare.

A balanced framework remains essential to strike a deal, and the looming fiscal crisis provides a "magic moment" to get it done, says Bowles.?"To get something done in this town, you need a crisis ? and we've got it," he says. But a bipartisan plan still requires support in both chambers from both Republicans and Democrats.

Biggest black hole blast discovered: Most powerful quasar outflow ever found

ScienceDaily (Nov. 26, 2012) ? Astronomers using ESO's Very Large Telescope (VLT) have discovered a quasar with the most energetic outflow ever seen, at least five times more powerful than any that have been observed to date. Quasars are extremely bright galactic centres powered by supermassive black holes. Many blast huge amounts of material out into their host galaxies, and these outflows play a key role in the evolution of galaxies. But, until now, observed quasar outflows weren't as powerful as predicted by theorists.

Quasars are the intensely luminous centres of distant galaxies that are powered by huge black holes. This new study has looked at one of these energetic objects -- known as SDSS J1106+1939 -- in great detail, using the X-shooter instrument on ESO's VLT at the Paranal Observatory in Chile [1]. Although black holes are noted for pulling material in, most quasars also accelerate some of the material around them and eject it at high speed.

"We have discovered the most energetic quasar outflow known to date. The rate that energy is carried away by this huge mass of material ejected at high speed from SDSS J1106+1939 is at least equivalent to two million million times the power output of the Sun. This is about 100 times higher than the total power output of the Milky Way galaxy -- it's a real monster of an outflow," says team leader Nahum Arav (Virginia Tech, USA). "This is the first time that a quasar outflow has been measured to have the sort of very high energies that are predicted by theory."

Many theoretical simulations suggest that the impact of these outflows on the galaxies around them may resolve several enigmas in modern cosmology, including how the mass of a galaxy is linked to its central black hole mass, and why there are so few large galaxies in the Universe. However, whether or not quasars were capable of producing outflows powerful enough to produce these phenomena has remained unclear until now [2].

The newly discovered outflow lies about a thousand light-years away from the supermassive black hole at the heart of the quasar SDSS J1106+1939. This outflow is at least five times more powerful than the previous record holder [3]. The team's analysis shows that a mass of approximately 400 times that of the Sun is streaming away from this quasar per year, moving at a speed of 8000 kilometres per second.

"We couldn't have got the high-quality data to make this discovery without the VLT's X-shooter spectrograph," says Benoit Borguet (Virginia Tech, USA), lead author of the new paper. "We were able to explore the region around the quasar in great detail for the first time."

As well as SDSS J1106+1939, the team also observed one other quasar and found that both of these objects have powerful outflows. As these are typical examples of a common, but previously little studied, type of quasars [4], these results should be widely applicable to luminous quasars across the Universe. Borguet and colleagues are currently exploring a dozen more similar quasars to see if this is the case.

"I've been looking for something like this for a decade," says Nahum Arav, "so it's thrilling to finally find one of the monster outflows that have been predicted!"

[1] The team observed SDSS J1106+1939 and J1512+1119 in April 2011 and March 2012 using the X-shooter spectrograph instrument attached to ESO's VLT. By splitting the light up into its component colours and studying in detail the resultant spectrum the astronomers could deduce the velocity and other properties of the material close to the quasar.

[2] The powerful out?ow observed in SDSS J1106+1939 carries enough kinetic energy to play a major role in active galaxy feedback processes, which typically require a mechanical power input of roughly 5% of the luminosity of the quasar. The rate at which kinetic energy is being transferred by the outflow is described as its kinetic luminosity.

[3] SDSS J1106+1939 has an outflow with a kinetic luminosity of at least 1046 ergs s?1. The distances of the outflows from the central quasar (300-8000 light-years) was greater than expected suggesting that we observe the outflows far from the region in which we assume them to initially accelerated (0.03-0.4 light-years).

[4] A class known as Broad Absorption Line (BAL) quasars.

'Fiscal cliff' talks stalled but progress possible

WASHINGTON (Reuters) - U.S. lawmakers have made little progress in the past 10 days toward a compromise to avoid the harsh tax increases and government spending cuts scheduled for January 1, a senior Democratic senator said on Sunday.

The United States is on course to slash its budget deficit nearly in half next year. Closing the gap that quickly, which in Washington is referred to as going over a "fiscal cliff," could easily trigger a recession.

"Unfortunately, for the last 10 days, with the House and Congress gone for the Thanksgiving recess ... much progress hasn't been made," Dick Durbin, the No. 2 Senate Democrat, told ABC's "This Week" program.

Serious negotiations are expected to resume this week. Democratic and Republican lawmakers have been trying to convince the public - and financial markets - that they are willing to compromise and can reach a deal before the end of the year.

Durbin indicated Democrats might accept a reform of the government's Medicare health insurance program for the elderly that would make higher-income seniors pay more for their care.

Democrats traditionally oppose limiting Medicare benefits according to income, a practice known as "means testing." Durbin said Medicaid, a public health insurance program for the poor, also could be overhauled.

But Durbin said Social Security, the federal government pension program, needs only small tweaks to ensure long-term solvency rather than major reforms.

A deadline looms over the talks. Without action by lawmakers and President Barack Obama, roughly $600 billion in tax increases and spending cuts will start to hit households and companies in early January.

    'TEST OF POLITICAL COURAGE'

Republicans are averse to Democrats' plan to raise income tax rates on the wealthiest Americans, which Republicans say would hurt job creation.

Republicans also want to cut spending on social programs more than Democrats say they will accept.

House Speaker John Boehner has called for a short-term plan to avert the fiscal cliff to pave the way for Congress and the White House to agree to work during 2013 on comprehensive tax reform and longer-term spending cuts.

But Republican Senator Bob Corker said both sides need to show "political courage" and reach a bigger $4 trillion deficit reduction deal that includes both increases in revenues and cuts in spending by the end of the year.

"Kicking the can down the road ? setting up a process for token deficit reduction today with the promise of more reforms later ? is misguided and irresponsible and shows a total lack of courage," Corker wrote in an editorial in the Washington Post.

    TAX REVENUES

A growing group of Republican lawmakers are loosening their ties to Grover Norquist, the anti-tax activist famous for getting elected officials to sign a pledge that they will vote against any tax increases.

Republican Senator Lindsey Graham said Republicans will allow tax revenues to rise as long as social spending programs are reformed. "I will violate the pledge - long story short - for the good of the country, only if Democrats will do entitlement reform," he told "This Week."

Graham said he supported boosting revenues by closing tax loopholes rather than by raising tax rates.

Republican Senator Saxby Chambliss said last week he "cared more about the country" than a 20-year-old pledge. On Sunday, Republican Representative Peter King, chairman of the House Homeland Security Committee, told NBC's "Meet the Press" he agreed with Chambliss.

While income tax breaks have attracted the most scrutiny, lawmakers also need to come to terms on a host of other tax incentives that are set to expire at the end of the year, including an estate tax break.

Senator Max Baucus, the chairman of the Senate Finance Committee and a key player in fiscal cliff talks, told a newspaper in his home state of Montana that he wants to preserve the estate tax break, which is important for farmers who want to pass down land worth millions of dollars to their children.

Baucus also said he hopes to preserve the production tax credit for wind energy, he told the Great Falls Tribune.

Churn: The Problem Of The New Tech Journalism

coffeegrinderEnterpriseA decade ago, the news cycle for a CE product worked like this: a PR person contacted a major title - Laptop, say, or PC Magazine - and offered an exclusive for a cover story. "Hey," they'd say. "Hot new laptop coming out! It's got that new Wi-Fi!" An early version of the laptop would arrive at the title's office and someone would write a detailed review of it because, let's face it, there was little else to do at the office before the Internet was pervasive. Then, two months later the story would go to press and then maybe end up on some nascent Internet CMS hacked together by a designer after hours. The circle of life, then, for a tech product was about half a year. Plenty of time for back and forth, hand-holding, and handsome product shots.

No Powerball winner; jackpot goes to record $425M

DES MOINES, Iowa (AP) ? Lottery officials say nobody has won the Powerball jackpot and the top prize will now increase to about $425 million for the next drawing, the largest jackpot ever for the game.

Iowa Lottery spokeswoman Mary Neubauer said sales were strong over the holiday week for Saturday's drawing, which was estimated at $325 million before the numbers were picked. That was the fourth-largest jackpot in the game's history.

Neubauer says the jackpot for Wednesday's drawing could go even higher than the estimated $425 million because sales pick up in the days before record drawings.

The previous top Powerball prize was $365 million, won in 2006 by ConAgra Foods Workers in Lincoln, Neb.

The Powerball numbers for Saturday were 22-32-37-44-50, and the Powerball was 34.

Mark Wahlberg's trainer gives women a workout plan - one Brik at a ...

Men have an easier time building muscles and losing weight.? That said the difference in training approaches towards women warrants some expert advice.? Knowing this,?Mark Wahlberg?and his long-time friend and trainer, Brian Nguyen, teamed up with Nik Herold to create the Brik Fitness studio, Brik Fitness. Brian remodeled the formula he uses on Wahlberg into a female friendly all-in-one workout. The formula (Brik Fitness) is a blueprint that leads clients on the road to successfully achieving their health and weight goals.

The Brik Fitness studio launches just in time for the holidays, and will help clients get on the right track for 2013. Brian and Nik share why their formula works, their reasoning for having an all-woman workout and tips on working out when you think you don?t have enough time.

    Q&A

Q: Why a gender tailored program?

A: Everyone needs a plan and men and women are different. It's simple.? If you want to go somewhere, you need a map.? If your destination is to lose two pants sizes, then you need to know where you are (START) and where you want to go (END). Seek the advice of a professional to help you map out the route.

    ?

Q: How do you see Mark balance his career, family and health, and how can you parlay advice of what you've seen for women to do the same?

A: Mark Wahlberg does a great job of prioritizing his health. ?He realizes that he is the engine for his family. ?So many of us take ourselves off the priority list, in order to give more attention to work, kids, etc. ?However, it's like the oxygen mask on an airplane, we must take care of ourselves first in order to be better for those who need us. Once you consider being active for at least 30 minutes a day like brushing teeth, it becomes less of a chore. ?Also, Mark doesn't work out alone. Find some social support and workout with someone to keep you in the game.? ( I wouldn?t mind being Mark?s workout partner- just saying!)

    ?

Q: What?s the biggest differentiation factor for successful training?

A: Social support! Whether it's working out with a friend, family or coach, having someone else will help keep you motivated and make the experience more enjoyable. ?This is why Brik Fitness only offers semi-private and group training. It is just THAT important to have social support.
Q:? What are five must do moves that women need in their weekly fitness programs?

A: The five must do moves are:
1.??Foam roll?- We develop tight muscles through our daily routines (sitting,? driving, etc), and it's important to loosen them? up to prevent any injuries.

2.??Jump rope?- A great warm-up and a great exercise to help your posture and? metabolism.

3.??Plank exercises?-? A strong core is a stable one.? Forget crunches as they only? work one side.? Planks work all 4 sides of your core.

4.??The inverted row?- This exercise is a huge bang for your buck since it? addresses that shoulder slump and weak backside.

5.??Dead lift?- Time to pick up some weight off the floor!? Again, whether using a? bar, a kettlebell or dumbells, it's so important to strengthen your backside.

    ?

Having a work out partner is a great way to help you stay accountable for your workouts. Having a body blueprint that adheres to your specific needs and capabilities help you to get on the right track and stay focused. Following Brian and Nik?s tips from Brik Fitness will help you have more fun losing weight and keep you on the right track.?? Hey it works for Mark Wahlberg?

China sovereign wealth fund official warns on eurozone austerity

Riot police and protesters clash in Rome

A top official with China's sovereign wealth fund has issued a blunt warning that the latest unrest across the eurozone shows austerity has stretched the public's tolerance "to breaking point".

Jin Liqun, chair of the supervisory board of the $480bn (?300bn) China Investment Corporation (CIC), warned that undue harshness risked a backlash which could end with necessary economic reforms being abandoned.

Jin has been extremely critical of Europe's handling of the debt crisis, warning that authorities have taken a piecemeal approach and suggesting Greece should be given more time to work off its debt. But he has previously stressed the need for Europeans to "work a bit harder ? work a bit longer" like Chinese citizens, complaining about "sloth-inducing" labour laws.

Speaking at a forum in Beijing on Friday he repeated his warning that governments had spent unsustainably in the past.

But he went on to warn that Europe was now seeing social and political unrest across several states.

"One commonality is that unions are now involved in organised protests; demonstrations and strikes. It smacks of the solidarity movement witnessed in the 1930s," he said.

"The general public's tolerance of austerity has been stretched to breaking point."

Jin pointed to the unemployment rates in Spain and Greece and added: "The worst case could be a complete discarding of austerity programmes. The fact the public are taking to the streets and resorting to violence indicates the general public's tolerance has hit its limits."

He went on: "The eurozone needs to strike a proper balance between austerity and growth. Austerity without growth is a cul de sac."

Jin also suggested that the European Central Bank should launch further unorthodox measures to help the eurozone, which is now officially in recession.

"Monetary easing is considered too radical but we believe it to be a practical move. The crisis is pulling the economy underwater.

"People need breathing space. People should be helped to implement austerity programmes."

Jin told the Guardian after his speech: "European governments should be given some time ? If you ask the Greek people to slash their spending by 30-40%, it's not possible. So there should be some tolerance, but the determination to carry on austerity should not be relaxed. It is only the issue of how you can balance one against the other."

CIC is one of the world's biggest sovereign wealth funds and recently bought a 10% stake in Heathrow airport.

On Wednesday, Europe saw its biggest ever protests against austerity. There were general strikes in Spain and Portugal, walkouts in Italy and Greece, and demonstrations in hundreds of cities across the region. Demonstrators clashed with riot police in Milan, and rubber bullets were fired in Madrid and Barcelona.

? Jin was speaking at a forum organised by business magazine Caixin. The Guardian is a media partner of the event.

LinkedIn founder Reid Hoffman interviewed Microsoft's CEO Steve Ballmer at an event with "tech influencers and innovators", and a bunch of of us press folk. Ballmer is riding on the release of Windows 8, Surface and the Windows 8 Phone, so there is plenty to talk about. Benefits of SandBells Over Dumbbells, Medicine Balls, and Kettlebells

    By Sam Dowd

Whether you?re a health and fitness expert or a gym enthusiast, there will be a time when you want to buy personal training equipment. Training gear can be expensive and certain factors should be considered before making a purchase. Exercise equipment should meet a set of standards before being considered a worthwhile addition to your training gear. Namely, equipment must be cost effective, and maintain durability and versatility throughout its life span.

HyperWear?s signature piece of fitness equipment, the SandBell?, is the perfect example of their dedication to provide health and fitness consumers and trainers with training gear that embodies the aforementioned qualities. While it?s not practical to name all of the benefits of SandBells in a few paragraphs, comparing SandBells with dumbbells, medicine balls, and kettlebells will give you a better understanding of the functionality of this exciting product.

A closer look at the SandBell is warranted to fully appreciate this product in relation to other strength training modalities. When HyperWear first began construction on the SandBell, they wanted to create a product durable enough to withstand serious use and abuse. The end result was the toughest piece of strength training equipment you will ever use! Constructed from a heavy-duty neoprene outside and leak-resistant stitching, the SandBell can be dropped, thrown, tossed or slammed without damage to the SandBell, the user, or other equipment.

sandbell diagram2 500x250 Benefits of SandBells Over Dumbbells, Medicine Balls, and Kettlebells

As the SandBell?s durability is unmatched, so too is its cost-effectiveness. Most free weights, medicine balls, and kettlebells are very expensive per pound and limited in both function and versatility. Pound-for-pound, the SandBell is the most cost effective tool for boosting your resistance-training regimen. For example, a 10 lb. medicine ball costs $89, a filled 10 lb. SandBell is $21.99, and a 10 lb. kettlebell ranges from $25-$60+. The SandBell can be used in all the same ways a medicine ball, plus it can be slammed or thrown against almost any surface. The SandBell can replace the kettlebell, dumbbell or stability ball for most exercises, giving you multiple products in one.

Let?s compare the SandBell to the dumbbell. Most gym goers are fairly comfortable with the dumbbell, but in many training contexts, investing your time and energy into a SandBell workout is more beneficial. While dumbells offer a static resistance (fixed weight attached on either end of a handle), the SandBell gives users a dynamic resistance in the form of shifting sand. This dynamic resistance allows for greater muscle fiber recruitment in the abdominal and grip muscles regardless of the movement pattern being performed.

As shown below, the SandBell can be used in place of a dumbbell for exercises like the bent-over row. In addition to working targeted arm, shoulder and back muscles, the SandBell also challenges grip and abdominal muscles. This is because the sand inside the SandBell is dynamic, requiring the user to grip into the bell while activating their core to stabilize the shifting weight. Additionally, the SandBell can be dropped, thrown or tossed?free weights can injure workout participants or damage equipment if used incorrectly or dropped.

bent over row Benefits of SandBells Over Dumbbells, Medicine Balls, and Kettlebells

SandBell in place of a dumbbell for bent over rows

Now let?s compare SandBells to medicine balls. Many fitness enthusiasts marvel at the functionality of the medicine ball. But, what can it do that a SandBell can?t do better? Medicine balls build explosive hip and abdominal strength and work well for many rotational movement patterns. Training with a SandBell provides better results during same exercises and at a lower cost. As with dumbbells, medicine balls do not provide your core or grip muscles the dynamic resistance found in a SandBell. Ultimately medicine balls simply cannot compare with the functionality of a SandBell!

The picture below shows a SandBell Slam. SandBell Slams are more challenging than med ball slams because the user has to squat down and pick up the SandBell since, unlike a med ball, the SandBell doesn?t bounce. SandBell Slams are one of the best training exercises for developing explosive power and activating almost every muscle group in the body. Because SandBells were made to withstand extreme force, you don?t have to worry about it bursting or leaking sand (slamming is covered in the user warranty).

sandbell slam 500x333 Benefits of SandBells Over Dumbbells, Medicine Balls, and Kettlebells

SandBell used in place of a medicine ball for a slam

Finally, a kettlebell training regimen would benefit by substituting a SandBell?s in the workout. Using a SandBell in any Olympic-style lift typically performed with a kettlebell challenges the muscles in the midsection and grip in a way that kettlebells can?t. Try adding?SandBell swings or snatches to your training regimen to build more power through your hips and midsection. Swapping a kettlebell for a SandBell is a great option when working with kids or older adults where injury or safety is a concern.

The image below shows a one-arm snatch using the SandBell. In this exercise, the user starts with the SandBell on the floor and in one fluid motion pulls the SandBell from the floor up into the air and ends with the arm extended overhead. It?s important to keep the arm close to the body when doing this exercise. The SandBell Snatch is a great way to train for many Olympic lift exercises, as well as the hamstrings, calves, grip, forearm, shoulders and core.

SandBell used in place of a kettlbell for a one-arm snatch

The exercises mentioned above are only a brief glimpse into SandBell training. The Hyper Training Lab articles and videos present new and innovative ways to use this exciting strength training product. Hyperwear also offers Level 1 SandBell Training Workshops for personal trainers, coaches and instructors that are held throughout the US. These interactive workshops teach the science and philosophy behind SandBell training, and how to implement the SandBell into personal, small group and boot camp settings. So give the SandBell a try and see how much you can intensify your workouts and continually challenge your muscles with this one functional, versatile and dynamic fitness product.

AUSTIN, Texas (AP) ? A son of Depression-era Oklahoma, Darrell Royal came to Texas to take over a sleeping giant of a football program. Over 20 years, his folksy approach to sports and life, his inventive wishbone offense and a victory in the "Game of the Century" ? where a U.S. president declared his team national champion ? made him an icon of college football.

Royal, who won two national championships and turned the Longhorns program into a national power, died early Wednesday at age 88 of complications from cardiovascular disease, school spokesman Bill Little said. Royal also had suffered from Alzheimer's disease.

Royal didn't have a single losing season in his 23 years as a head coach at Texas, Mississippi State and Washington. Known for their stout defenses and punishing running attacks, his Texas teams boasted a 167-47-5 record from 1957-1976, the best mark in the nation over that period.

"It was fun," Royal told The Associated Press in 2007. "All the days I was coaching at Texas, I knew this would be my last coaching job. I knew it when I got here."

It almost didn't happen. Royal wasn't Texas' first choice.

Texas was coming off a 1-9 season in 1956 ? still the worst in program history ? and wanted a high-profile coach to turn things around. The Longhorns were rebuffed by Georgia Tech's Bobby Dodd and Michigan State's Duffy Daugherty, but both coaches encouraged Texas to hire the 32-year-old Royal, who was lying in bed the night he got the call summoning him to Austin.

"Edith, this is it, this is the University of Texas," Royal told his wife.

Royal led the Longhorns to a 6-3-1 record in his first season, but he was so sickened by Mississippi's 39-7 thrashing of his team in the Sugar Bowl that he gave away the commemorative bowl watch he received.

Under Royal, Texas won 11 Southwest Conference titles, 10 Cotton Bowl championships and national championships in 1963 and 1969, going 11-0 each time. The Longhorns also won a share of the 1970 national title, earning him a national stature that rivaled that of Alabama's Paul "Bear" Bryant and Ohio State's Woody Hayes. Royal was inducted into the College Football Hall of Fame in 1983.

Funeral arrangements were not immediately announced, but Royal will be buried at the Texas State Cemetery in Austin, an honor typically reserved for the state's military and political leaders.

On Saturday, the Longhorns will honor Royal at their home game against Iowa State by wearing "DKR" stickers on their helmets and by lining up in the wishbone formation, which Royal used to such great success, for their first offensive snap.

"Today is a very sad day. I lost a wonderful friend, a mentor, a confidant and my hero. College football lost maybe its best ever and the world lost a great man," current Texas coach Mack Brown said Wednesday. "His council and friendship meant a lot to me before I came to Texas, but it's been my guiding light for my 15 years here."

As a player at Oklahoma, Royal was a standout quarterback, defensive back and punter, and he credited hard work and luck for his success on the field and later as a coach. He had a self-deprecating style and a knack for delivering pithy quotes ? or "Royalisms" ? about his team and opponents.

"Football doesn't build character, it eliminates the weak ones," was one of Royal's famous lines.

"Luck is when preparation meets opportunity," was another.

"He was a guy who was so strong and so determined and so direct about things," said former Texas quarterback James Street. "He was that way to the very end."

Royal and assistant Emory Ballard changed the football landscape in 1968 with the development of the wishbone, which features a fullback lined up two yards behind the quarterback and a step in front of two other backs.

The innovation nearly flopped. After a tie and loss in the first two games that season, a frustrated Royal inserted backup Street to take over.

"Coach Royal grabbed me and he looked for a minute as if he were having second thoughts about putting me in. Then he looked me straight in the eye and said, 'Hell, you can't do any worse. Get in there,'" Street said

Texas won its next 30 games. Soon, rival Oklahoma and other schools started using the wishbone as well.

"The University of Oklahoma joins the rest of the nation in celebrating the life's work of Darrell Royal," said Oklahoma athletic director Joe Castiglione. "We've truly lost an icon - a champion, an innovator and an educator."

The national title season in 1969 included what was dubbed the "Game of the Century," a come-from-behind, 15-14 victory by the top-ranked Longhorns over No. 2 Arkansas to cap the regular season.

In Texas lore, it ranks as the greatest game ever played. President Nixon, an avid football fan, flew in by helicopter to watch. Afterward, Nixon greeted Royal with a plaque in the Texas locker room proclaiming Texas the national champion.

The Longhorns also were named national champions by United Press International in 1970, a year in which Texas lost its final game to Notre Dame in the Cotton Bowl and finished 10-1.

Royal faced criticism over the lack of black players on his first 13 Texas teams, although he had coached black players at Washington and in the Canadian football league.

At the 1960 Cotton Bowl, Syracuse accused Texas of hurling racial barbs at Syracuse's black players, which Royal denied. Texas became the first SWC school to announce it would fully integrate the athletic program in 1963, but the football team didn't have a black letterman until Julius Whittier in 1970.

Royal, who acknowledged being unconcerned about racial discrimination for much of his life, credited former President Lyndon B. Johnson with turning around his viewpoint. Johnson, who attended Texas football games after his presidency ended, was close friends with Royal.

"I'm not a football fan," Johnson once said. "But I am a fan of people, and I am a Darrell Royal fan because he is the rarest of human beings."

In 1972, former Texas lineman Gary Shaw published "Meat on the Hoof," a searing critique of the Texas program that accused the coaches of having a class system within the program and of devising sadistic drills to drive off unwanted players. Royal tried to distance himself from the claims, saying in interviews he had "never heard" of the drills Shaw described.

"I want to be remembered as a winning coach, but also as an honest and ethical coach," Royal said in 1975.

Royal was among the first football coaches in the nation to hire an academic counselor ? sometimes referred to as a "brain coach" in that era ? to ensure athletes went on to graduate. He also set aside a fund for a special "T'' ring, which players received upon graduation. Royal also served as Texas athletic director from 1962-1979.

The youngest of six children born to Katy and B.R. "Burley" Royal, he grew up in tiny Hollis, Okla., where he chopped cotton as a young boy for 10-cents an hour to help his family through the Depression. His mother died before he was 6 months old, and he lost two sisters to a fever epidemic.

In 1938, Royal's father took the family from the Dustbowl to California to look for work. Homesick for Oklahoma, Royal soon packed his bags and hitchhiked his way back.

Royal is survived by his wife, Edith, and a son, Mack. The couple had two other children, daughter Marian, who died in 1973, and son David, who died in 1982.
