Kentucky Offers More Than 250 Different Tax Breaks | LEX18.com ...
LOUISIVLLE, Ky. (AP) - Kentuckians can take advantage of a multitude of tax breaks, whether for parsonages and public assistance benefits, prescription drugs or personal airplanes.
In all, the state tax code offers 253 tax breaks that add up to more than $12 billion in annual tax relief, according to the Governor's Office for Economic Analysis.
That's more than all the revenue that goes to the state's general and road fund funds combined.
The Courier-Journal (http://cjky.it/TefIag) reports that critics say all those tax breaks are slowly bleeding the state government and its agencies dry at a time when funding for education and programs that help the neediest Kentucky residents is being cut.
"The major problem, at least in my mind is we've picked away at that tax structure with exemptions that individually seemed fairly harmless at the time, but the totality of the exemptions and special provisions has impacted the growth potential and equity of the system," Merl Hackbart, a University of Kentucky finance professor and former state budget director, told the newspaper.
With that in mind, Gov. Steve Beshear's Blue Ribbon Commission on Tax Reform is examining the state's tax breaks as part of its job of recommending ways to make the tax code more equitable and better able to generate the revenue state government needs to pay its bills.
"It's obviously something we're looking at," said commission member Pat Mulloy, chief executive officer of Elmcroft Senior Living and a former state finance secretary. "If Kentucky, or any state, doesn't pause to do a comprehensive tax reform ... over time you get these leakages."
But any attempt to curtail the state's wealth of tax breaks will face fierce opposition from lobbyists, who argue that those breaks do far more good than harm by keeping money in the private economy, where it is best spent.
During this summer's hearings of the tax reform commission, farmers, real estate agents, restaurant owners, manufacturers and others have pleaded to keep the breaks they have or asked for even more.
Kentucky lawmakers' love affair with tax breaks has a long history.
In 1995, for instance, after big gains by conservative Republicans in the national and state elections, tax-cutting fever ran high in Frankfort.
Although he had just appointed a commission to recommend a thoughtful, comprehensive reform of the state tax code, Democratic Gov. Brereton Jones caught the fever.
The economy was starting to boom, and politicians figured the short-term budget outlook could handle some cuts, particularly if they were phased in.
So Jones called a special session, and lawmakers quickly and overwhelmingly exempted private pensions from the state income tax, an action that is estimated to now cost $465 million in state revenue every year.
In 1998, lawmakers significantly lowered a cap on the amount airlines pay in sales tax for jet fuel. The move was said to be key to Comair Inc.'s decision to spend $25 million to expand its operations at the Cincinnati-Northern Kentucky International Airport in Hebron, Ky.
Comair, now owned by Delta Air Lines, recently announced it will cease operations this fall, yet the tax break remains in effect, costing the state $24.9 million.
In 2000, legislators approved a reduction in the coal severance tax for coal mined from thin seams, a revenue reduction of $2.4 million last year.
Closing any of those tax breaks, even small ones, will not be easy, legislators say.
"I doubt you can close them without lowering rates substantially or maybe going in and lowering income tax rates," said Rep. Rick Rand, the Bedford Democrat who chairs the House budget committee.

China surveillance ships enter waters near disputed islands
TOKYO (Reuters) - Two Chinese marine surveillance ships entered what Japan considers its territorial waters near disputed islands in the East China Sea on Monday, prompting an official protest from Tokyo amid rising tension between Asia's two biggest economies.
China's Xinhua news agency confirmed that two civilian surveillance ships were undertaking a "rights defense" patrol near the islands, citing the State Oceanic Administration, which controls the ships.
Japan's Foreign Ministry said it had lodged an official protest with the Chinese envoy to Japan against the move.
Sino-Japanese relations deteriorated sharply after Japan bought the islands, called Senkaku in Japan and Diaoyu in China, sparking anti-Japan protests in cities across China.
"In recent days, Japan has constantly provoked incidents concerning the Diaoyu islands issue, gravely violating China's territorial sovereignty," China's Xinhua news agency said.
The ship patrols were intended to exercise China's "administrative jurisdiction" over the islands, it said.
"Following the relevant laws of the People's Republic of China, (the ships) again carried out a regular rights defense patrol in our territorial waters around the Diaoyu islands."
The Japanese Coast Guard ordered the Chinese ships to move out of the area, but received no response, an official said.
Besides the two marine surveillance ships, there were nine Chinese fishery patrol ships near the islands as of 7:00 a.m. (6 p.m. EDT on Sunday), but they were outside what Japan calls its territorial waters, the Coast Guard said.
Sino-Japanese ties have long been plagued by China's memories of Japan's military aggression in the 1930s and 1940s and present rivalry over regional influence and resources.
The islets are located near rich fishing grounds and potentially huge gas reserves.
The latest flare-up in tensions comes when both countries focus on domestic political pressures. Japanese Prime Minister Yoshihiko Noda's government faces an election in months, adding pressure on him not to look weak on China.
China's Communist Party is preoccupied with a leadership turnover, with President Hu Jintao due to step down as party leader at a congress that could open as soon as next month.
Despite the long-running territorial disputes, their economic ties have grown closer over the years. China is Japan's largest trading partner. In 2011, their bilateral trade grew 14.3 percent in value to a record $345 billion.

Adele Springsteen danced and sang background to "Twist and Shout," walking offstage with her son and his band at nearly 2. Her only concession to age was a pair of hastily made earplugs.
She watched as her son cut a giant cake in the shape of a guitar, passing out pieces to some audience members.
His show in the open-air MetLife Stadium was delayed three hours Saturday by authorities because of a downpour and worries about lightning. Thousands of fans clustered on indoor ramps waiting for the rain to stop.
When it did, Springsteen and his E Street Band took the stage at 10:30 p.m. to the strains of Wilson Pickett's "In the Midnight Hour," a song they performed when the clock hit that mark. They also covered Creedence Clearwater Revival's "Who'll Stop the Rain," and it worked.
"Thank you for your patience," Springsteen told the audience. He said it had been a long time since he had performed on his birthday.
It was the third of a three-night stand at his home state arena.

Characteristics of the population eligible for and receiving publicly funded bariatric surgery in Canada

Background
Bariatric surgery is the most effective current treatment for severe obesity. Capacity to perform surgery within Canada's public health system is limited and potential candidates face protracted wait times. A better understanding of the gaps between demand for surgery and the capacity to provide it is required. The purpose of this study was to quantify and characterize the bariatric surgery-eligible population in Canada in comparison to surgery-ineligible subjects and surgical recipients.
Methods
Data from adult (age > 20) respondents of the 2007--09 nationally representative Canadian Health Measures Survey (CHMS) were analyzed to estimate the prevalence and characteristics of the surgery-eligible and ineligible populations. Federally mandated administrative healthcare data (2007--08) were used to characterize surgical recipients.
Results
In 2007--09, an estimated 1.5 million obese Canadian adults met eligibility criteria for bariatric surgery. 19.2 million were surgery-ineligible (3.4 million obese and 15.8 million non-obese). Surgery-eligible Canadians had a mean BMI of 40.1 kg/m2 (95% CI 39.3 to 40.9 kg/m2) and, compared to the surgery-ineligible obese population, were more likely to be female (62 vs. 44%), 40--59 years old (55 vs. 48%), less educated (43 vs. 35%), in the lowest socioeconomic tertile (41 vs. 34%), and inactive (73 vs. 59%). Self-rated mental health and quality of life were lower and comorbidity was higher in surgery-eligible respondents compared with the ineligible populations. The annual proportion of Canadians eligible for surgery that actually underwent a publicly funded bariatric surgery between 2007--09 was 0.1%. Surgical recipients (n = 847) had a mean age of 43.6 years (SD 11.1) and 82% were female. With the exception of type 2 diabetes, obesity-related comorbidity prevalence was much lower in surgical recipients compared to those eligible for surgery.
Conclusions
The proportion of bariatric surgery-eligible Canadians that undergo publicly funded bariatric surgery is very low. There are notable differences in sociodemographic profiles and prevalence of comorbidities between surgery-eligible subjects and surgical recipients.

Apple does not have a store in Russia, however, and the company has not announced a release date for Russia. A simple internet search yields a number of gray market vendors promising to have the iPhone 5 in your hands as early as tonight. But it's going to cost you.
A 16 gigabyte iPhone 5 is going for around 70,000 rubles, or about $2,200. Other vendors are quoting prices up to $3,700. That's several times what it will cost you in an Apple store in the United States, where an unlocked version retails for $649.
When ABC News called several of the vendors, each promised to deliver the device by Saturday. Several said they expected a shipment to be flown in tonight.
Asked when he could deliver an iPhone 5, one vendor who only identified himself as Dima replied confidently: "Tomorrow." He promised to have any of the phone's variations, either black or white and in any of the three sizes available. "Cash only," he said.
The vendors say they're getting overwhelmed by calls asking for the iPhone 5, outpacing demand for the new iPad when it was released earlier this year.
Another vendor named Victor say his phones are coming from France. Others said their first shipment is also coming from France, with more expected from the United States later in the week.
Each vendor insisted they were operating legally, but wouldn't say if they had paid import duties to bring them into the country. Victor said his shop would offer a two week replacement guarantee on the phones, along with the one year warranty provided by Apple. Others said it was not possible to come see the devices in person because they did not have a physical store.
The iPhone 5 uses a nano SIM card, smaller than the micro SIM used in previous models, but it appears that Russian phone companies have anticipated the phone arriving in country before it officially goes on sale. One of them promises to have nano SIM cards available by Saturday. Other companies are planning to have them available by Tuesday. One of the internet vendors also said he could produce a nano SIM card in his shop.
Even before the iPhone 5 came out, smugglers have made good money bringing in the latest devices from the United States and Europe. For example the previous Apple phone, the iPhone 4S, is available from telephone companies for just under 30,000 rubles, which is a shade under $1,000. That device also sold for $649 in the United States before today, providing a healthy profit margin for anyone willing to sneak one into the country.

Sheriff: Mother kills 2 kids, then hangs self
A 34-year-old Florida woman apparently killed her two children in their house and then committed suicide by hanging herself from a ceiling fan, the Pinellas County Sheriff's Office said Saturday.
Deputies responded to a house in unincorporated Clearwater, west of Tampa,?shortly?after 2 a.m. after receiving a call for help. They discovered Dawn Brown and her two children, ages 5 and 9, dead in the house.
It?s believed that Brown killed her two children and then hanged herself with an electrical cord from a bedroom ceiling fan, the sheriff?s office said.
No details were revealed on how the children were killed. Their cause of death will be released after an autopsy, the sheriff?s office said.
Authorities did not give a possible motive for the killings.

Coffee shops with signs offering ?Free WiFi? bring us through the door so we can enjoy sipping our favorite brew ? a large dark-roast (with cream) for yours truly ? while wirelessly accessing the Internet using our laptops and mobile devices.
As we know, nothing stays the same in this world, especially when it comes to technology.
Soon, we may be seeing those coffee shop signs offering us ?Free WiGig.??
Wireless Gigabit or WiGig, is the next wireless technology standard we may be tethering to when accessing the Internet from our mobile computing devices.
WiGig has been under development since 2009, and in addition to being used to complement WiFi; it will free us from the various cables used when connecting computing hardware.?
?In the future, if it computes, it connects. From the simplest embedded sensors to the most advanced cloud data centers, we?re looking at techniques to allow all of them to connect without wires,? said Intel Chief Technology Officer Justin Rattner at this year?s Intel Developer Forum.
And WiGig will be able to handle the job.?
With data transmission speeds reported at a lighting fast 7 to 10 gigabits per second, WiGig will be around 10 times faster than today?s fastest wireless 802.11n network based Wi-Fi systems.?
One of the reasons WiGig is so much faster is because it operates in a different frequency bandwidth range.?
Current WiFi networks use the 2.4 GHz (gigahertz) and 5 GHz radio frequency bands.?
The 2.4 GHz range is used by most of our laptops and mobile devices when accessing the Internet. This range works well over a greater distance than the 5GHz bands, which is primarily used for our electronic Bluetooth devices that only need to operate over short distances.?
When talking about WiGig, the amount of wireless spectrum and speed that becomes available when compared to WiFi opens up tremendously ? we are talking WiGig wireless transmissions operating in the unlicensed 60 GHz frequency band.?
When used with Protocol Adaptation Layers (PAL), WiGig becomes functional for our personal computing and mobile applications.
In the near future, we may be using WiGig technology, instead of physical cords and cables for connections to our monitor display screens, keyboards, computing devices, and external hardware.
During this year?s Intel Developers Forum, Wireless Gigabit Alliance chairman Ali Sadri joined Rattner on stage to demonstrate how an Intel Ultrabook computer could wirelessly sync at high speeds to devices, such as docking stations, keyboards, monitors, and external network drives.
While watching a video of the demonstration, their first presentation didn?t work; not because the technology failed, but because the Ultrabook computer?s battery was drained from having been used the previous day and had not been re-charged.
This did cause a bit of embarrassment to the presenters.
Once the Ultrabook had a fully-charged battery installed, the demonstration went on without any problems.?
The demo showed how video (it could just as well have been any type of data) was transmitted wirelessly from a Vantec external hard drive sitting on the table, through the Ultrabook, and then wirelessly streamed from the Ultrabook to a pair of display monitors ? with no inter-cabling of the devices used.?
As I look at the cables currently cluttering my desk from my two display monitors, I think about the day when I will be able to get rid of them ? it will be a welcomed change.?

These new WiGig products will be designed to be compatible with today?s existing 802.11 Wi-Fi devices, so in the event the 60 GHz high-speed signal is unmaintainable, a connection to the lower speed 802.11 Wi-Fi network will be used.?
?Looking to the future, all computing will become wireless computing, with an ever-increasing demand for faster wireless communication,? said Rattner.
According to many folks in the computing industry, WiGig looks like the next wireless road to be traveled upon.?

In my last post, I talked about a presentation by Dr. Lee Lindquist at last week?s National Private Duty Association annual conference.? She is very impressive and those of us in non-clinical home care learned a lot.
She is also refreshingly blunt and tough with her messages to the elder care industry and the families and individuals we serve.? For those of you who do not subscribe to the Journal of American Geriatrics Society?? there may be?1 or 2 out there 
? The Care Company published a summary of a study Dr. Lindquist and her colleagues published.? The article is The Case of The Scary Caregiver!
For families, elders ? and home care agencies that are doing doing the right things the right way ? there are some great messages, including:
- Only 55% of the agencies did a federal background check and many agencies didn?t check for any type of criminal record.
At Support For Home In-Home Care, we are very aware of this problem.? From day 1, we hired a national firm that gives us 7 years (the maximum) of federal, state (all) and local information, as well as from the Sex Offender Registry and, of course, driving records.? In fact, we get updates from DMV whenever anything changes for one of our employees.? Unfortunately, most home care agencies where we are use the California Department of Justice for background checks.? That sounds good, but it ain?t.? The DOJ only provides 5 years (not 7) of California state and local information ? not good.
The second point from Dr. Lindquist?s study is:
- Only 1/3 of the agencies did any type of drug testing. That means that paid caregivers who might have a drug problem have access to a senior?s medications.
We also find this to be unacceptable for home care agencies.? At Support For Home, here is our process, and we wish everyone used it:
- We ask every applicant, at the time of their final?(often?3rd) interview,?if they are willing to do a drug test, in our office.? If their answer is no, they do not proceed any further.? Sometimes they say yes, but they need to get something from their car, and that is the last time we ever see them.
- If they proceed?with the drug test, it is a saliva-based, 10-point panel that literally occurs in our office, under our control.? If they test ?positive? for any of the 10 panels, and they disagree with the result, we administer the test again (using a new kit).? If the results are the same and they still maintain?that the results are wrong, we send the applicant, right then (not tomorrow or whenever), to a nearby medical lab for urinalysis.
- The medical lab, if involved, determines the reality of drug use and reports to us.
This takes a little more time and resources on our part, but there is no reason every home care agency cannot perform an equally reliable drug testing procedure.

Antibiotic use aids MRSA spread in hospital and infection control measures do little to prevent it, says hospital study
ScienceDaily (Sep. 20, 2012) ? The use of a commonly prescribed antibiotic is a major contributor to the spread of infection in hospitals by the 'superbug' MRSA, according to new research. The study also found that increasing measures to prevent infection -- such as improved hygiene and hand washing -- appeared to have only a small effect on reducing MRSA infection rates during the period studied.
MRSA -- methicillin-resistant Staphylococcus aureus -- is a bacteria that causes hospital-acquired infection and is resistant to all of the penicillin-type antibiotics frequently used in hospitals to prevent and treat infection. It can cause serious infections of the skin, blood, lungs and bones.
The researchers -- led by St George's, University of London -- tracked MRSA infection over 10 years from 1999 to 2009 at St George's Hospital, looking at how it has adapted to survive in a hospital environment and at factors that affected its prevalence. They found that a significant drop in MRSA rates coincided with a reduction in hospital prescriptions of ciprofloxacin, the most commonly prescribed antibiotic of the fluoroquinolone family.
Over a short period of the study, ciprofloxacin prescriptions fell from 70-100 daily doses for every thousand occupied beds to about 30 doses. In the same period, the number of patients identified by the laboratory to be infected with MRSA fell by half, from an average of about 120 a month to about 60. Following this, over the last two years of the study both the drug prescription level and MRSA rates remained at these reduced levels. Symptoms of MRSA infection can range from very mild to severe, but it is not known how many of the cases examined in the study were serious.
The study -- published in the Journal of Antimicrobial Chemotherapy -- looked at whether other factors such as improved infection control measures may have contributed to this decrease in infection. However, during a four-year period when more stringent infection control policies were introduced -- including improved cleaning and hand washing, and screening patients for MRSA on arrival at hospital -- the only major reduction in MRSA infection rates coincided with the reduction in ciprofloxacin prescriptions.
Lead author Dr Jodi Lindsay, a reader in microbial pathogenesis at St George's, University of London, said: "Surprisingly, it wasn't hygiene and hand washing that were the main factors responsible for the decrease in MRSA in the hospital. Rather, it seemed to be a change in the use of a particular group of antibiotics. Hand washing and infection control are important, but they were not enough to cause the decrease in MRSA we saw."
Dr Lindsay said the study suggested that MRSA relies on ciprofloxacin -- and fluoroquinolones in general -- to thrive in hospitals, as well as penicillin-type drugs, which was already assumed. The fluoroquinolone group of antibiotics have a similar enough mechanism of action to assume that the effect would be the same for them all.
She added that the findings suggest the most effective way to control MRSA and other hospital-based superbugs is to continue finding alternative ways to use antibiotics, rather than simply focusing on infection control techniques.
As well as identifying factors that influenced prevalence, the researchers identified the strain of MRSA that has become dominant. This strain -- CC22 -- has thrived by developing and maintaining multi-drug resistance, and becoming more fit to survive on hospital surfaces than other strains.
Dr Tim Planche, consultant microbiologist at St George's Healthcare NHS Trust and one of the co-authors of the study, said: "The Trust currently has infection rates among the lowest in London, having successfully driven acquisitions down over the past five or six years using a combination of both tough hygiene regimes and careful selective use of antibiotics. These findings, however, provide valuable insight and certainly warrant further investigation, which could lead to the development of even more effective infection control strategies in future."
Dr Lindsay said that studying the dynamic of how MRSA bacteria strains continue to evolve in hospitals in response to changing practice and interventions, such as infection control and antibiotic prescribing, will be essential to determine which interventions work, which are cost effective, and which are likely to have the best long-term outcomes.
She added: "But it seems that we now have an excellent opportunity to control superbugs in hospitals by re-examining how we prescribe antibiotics and ensuring we're using them in the most effective way possible."
